Welcome to Mercadu.shop (“Mercadu”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, marketplace, classified ads platform, and related services.

By accessing or using Mercadu.shop, you agree to be bound by these Terms. If you do not agree, please discontinue use of the platform.

Section 1 – Platform Overview

Mercadu.shop operates as:

  • An online marketplace for new products

  • A classified ads platform for pre-loved items

  • A platform for services

  • A platform that displays affiliate products linking to third-party websites

Unless explicitly stated, Mercadu does not own, sell, store, ship, or deliver products listed on the platform. Mercadu.shop acts solely as a neutral intermediary connecting buyers and sellers and does not act as an agent, broker, or representative of any vendor, seller, or affiliate merchant.

Section 2 – Eligibility & Accounts

You must be at least 18 years old or the legal age in your jurisdiction to use Mercadu.shop.

You are responsible for maintaining the confidentiality of your account credentials. All activity under your account is your responsibility.

Mercadu reserves the right to suspend or terminate accounts immediately and without prior notice for violations of these Terms or applicable laws.

Section 3 – Affiliate Products & External Links

Some products displayed on Mercadu.shop contain affiliate links that redirect users to third-party websites.

Affiliate products are sold, fulfilled, and delivered by external merchants. Mercadu does not control pricing, shipping, warranties, or returns for affiliate products.

Mercadu may earn a small commission if you make a purchase through an affiliate link, at no additional cost to you.

All purchases through affiliate links are subject to the terms and policies of the respective third-party merchants.

Section A – Customer (Buyer) Terms

Section 4 – Customer Responsibilities

As a customer, you agree to:

  • Review product or service descriptions carefully before making a purchase

  • Communicate respectfully and honestly with sellers

  • Provide accurate and complete delivery information

  • Be available to receive and pay for orders upon Cash on Delivery (COD)

  • Review and acknowledge the seller’s stated delivery timelines, shipping fees, and obligations prior to placing an order

  • Promptly notify and communicate directly with the seller if an item is received defective, damaged, incomplete, or materially different from its description, in order to arrange any return, replacement, or refund in accordance with the seller’s stated policies

  • Review the seller’s store policies, including return, refund, exchange, and warranty terms, prior to purchase. By placing an order, the customer acknowledges and agrees to the individual seller’s applicable policies

⚠️ Customers must not send payments directly to sellers via personal bank accounts, e-wallets, messaging apps, or any off-platform method. Mercadu.shop does not require or authorize any upfront payment for Cash on Delivery (COD) transactions. Any payment made outside the official Mercadu.shop checkout system is done at the customer’s sole risk, and Mercadu.shop shall not be liable for any loss, damage, fraud, or dispute arising from such off-platform payments.

Section 5 – Payments & Cash on Delivery (COD)

For all products listed on Mercadu.shop, vendors agree to the following:

  • All payments must be processed exclusively through the official Mercadu.shop checkout system.

  • Allowed payment methods are those displayed on the checkout page, which may include:

    • Cash on Delivery (COD), if available

    • PayPal

    • E-wallets

    • Bank transfers or bank payments

For Cash on Delivery (COD) orders:

  • Customers must pay the full amount, including the product price and any applicable shipping fees.

  • Payment may be collected directly by the vendor or via an authorized courier service, depending on the delivery method.

  • If the customer is unavailable to receive the parcel, an authorized representative at the delivery address must receive and pay for the order.

  • Refusal to accept delivery without valid reason may result in account restrictions.

  • Customers must not send payments directly to vendors via personal bank accounts, e-wallets, messaging apps, or any off-platform method. Mercadu.shop does not require or authorize any upfront payment for COD transactions. Any off-platform payment is undertaken at the customer’s sole risk, and Mercadu.shop shall not be liable for any loss, damage, fraud, or dispute arising from such payments.

  • Vendors cannot request or accept any advance, partial, or off-platform payments. All payments must be made through the official Mercadu.shop checkout system or upon delivery via the authorized courier.

Section 6 – Delivery & Shipping (Customer Side)

Delivery timelines and courier details are provided by sellers. Mercadu.shop does not guarantee delivery dates.

Any delivery-related disputes must be resolved directly with the seller.

Mercadu.shop shall not be liable for delays or failures in delivery due to circumstances beyond its reasonable control, including natural disasters, courier disruptions, or government restrictions (Force Majeure).

Section B – Vendor / Seller Terms

Section 7 – Vendor Eligibility & Listings

By listing items or services on Mercadu.shop, vendors agree that:

  • All listings are accurate, truthful, and lawful

  • Item condition (New or Pre-Loved) is correctly disclosed

  • Listings comply with all Philippine laws and platform policies

  • Misleading or fraudulent listings are prohibited

Section 8 – Pricing, Payment Method & COD Policy

For all products listed on Mercadu.shop, vendors agree to the following:

  • All payments must be processed exclusively through the official Mercadu.shop checkout system.

  • Allowed payment methods are those displayed on the checkout page, which may include:

    • Cash on Delivery (COD), if available

    • PayPal

    • E-wallets

    • Bank transfers or bank payments

For Cash on Delivery (COD) orders:

  • Vendors must ensure that customers are aware of the total amount due, including product price and shipping fees.

  • Vendors must not request or accept any advance, partial, or off-platform payments.

  • COD may be collected either directly by the vendor or via an authorized courier service, depending on the delivery method chosen.

  • Violations of these rules may result in listing removal, account suspension, or permanent termination.

Section 9 – Delivery, Courier & Shipping Fees (Vendor Obligations)

Vendors are fully responsible for:

  • Arranging the delivery or courier service

  • Proper packaging and shipment of items

  • Setting and managing shipping fees through their vendor dashboard

  • Communicating delivery timelines clearly to customers

  • Providing a valid tracking number and tracking link once the item has been shipped

Mercadu.shop:

  • Does not provide courier services

  • Does not set shipping fees

  • Is not responsible for delivery delays, damages, or losses

Section 10 – Services Listings

Vendors offering services must:

  • Clearly state what the service includes

  • Avoid false guarantees or misleading claims

  • Ensure the service is legal to offer in the Philippines

Section 11 – Prohibited Items

The following items are strictly prohibited from being listed, sold, advertised, or linked to on Mercadu.shop. This list is not exhaustive:

11.1 Illegal, Dangerous, or Regulated Items

  • Illegal drugs, narcotics, controlled substances, and drug paraphernalia

  • Firearms, ammunition, explosives, grenades, bombs, and weapon parts

  • Bladed weapons intended for harm (daggers, switchblades, swords)

  • Firearm accessories requiring permits (silencers, magazines)

11.2 Counterfeit & Infringing Goods

  • Counterfeit, fake, or replica items presented as genuine

  • Items infringing trademarks, copyrights, or intellectual property rights

11.3 Stolen or Illegally Obtained Goods

  • Stolen items or goods of suspicious or unlawful origin

11.4 Adult, Obscene, or Exploitative Content

  • Pornographic or sexually explicit materials

  • Items involving sexual exploitation, abuse, or trafficking

  • Any content involving minors in any sexual or exploitative manner

11.5 Wildlife, Animals & Environmental Violations

  • Endangered, protected, or exotic animals and plants

  • Wildlife parts (ivory, animal skins, bones, shells)

  • Items violating Philippine environmental and wildlife protection laws

11.6 Medical & Health-Related Items

  • Prescription drugs without proper authorization

  • Unapproved medical devices or supplements

  • Items making false or misleading medical or health claims

11.7 Hazardous & Restricted Materials

  • Toxic, radioactive, or flammable materials without permits

  • Dangerous chemicals, pesticides, or regulated substances

11.8 Government, Legal & Official Items

  • Government-issued IDs, passports, licenses, or documents

  • Police, military, or government uniforms, badges, or insignia

11.9 Financial & Fraud-Related Items

  • Counterfeit currency or financial instruments

  • Credit cards, bank details, or identity documents

  • Tools or devices used for hacking, fraud, or identity theft

11.10 Gambling & Lottery Items

  • Illegal gambling services or equipment

  • Unauthorized lottery or betting activities

Mercadu.shop reserves the right to remove prohibited listings, suspend or terminate accounts, and report illegal activities to relevant authorities.

Section 12 – Content & Intellectual Property

All content on Mercadu.shop, including text, images, graphics, logos, and designs, is either the property of Mercadu.shop or used with permission from licensors.

All product images, brand names, and trademarks displayed on Mercadu.shop are the property of their respective owners. Mercadu.shop uses such content solely for identification, informational purposes, or in accordance with affiliate or sponsorship agreements. Inclusion of any logo, brand name, or trademark does not imply ownership by Mercadu.shop, and does not constitute an endorsement, sponsorship, or affiliation beyond any disclosed affiliate or sponsored relationship.

Users grant Mercadu.shop a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute any content they upload, post, or submit on the platform, including product listings, descriptions, and images, for the purpose of operating, promoting, and improving the platform.

Users are solely responsible for ensuring that any content they provide does not infringe upon the intellectual property rights, privacy rights, or other legal rights of third parties. Mercadu.shop reserves the right to remove any content that violates these Terms, applicable laws, or third-party rights.

Use of the platform is also governed by Mercadu.shop’s Privacy Policy, which forms part of these Terms.

Section 13 – Fees, Commissions & Membership Plans

  • Vendors may be required to subscribe to membership plans to list products or access certain platform features. Mercadu.shop offers a free plan for new sellers to explore and experience the platform before subscribing to higher-tier paid plans. Membership fees for paid tiers are determined by Mercadu.shop and are payable according to the plan chosen.

  • Vendors shall only be charged any commission or category-specific fees for transactions where Mercadu.shop processes the payment. Examples of such payment methods include:

    • PayPal

    • Bank transfers

    • E-wallets

  • No commission or listing fees are charged for transactions completed via Cash on Delivery (COD), since these do not involve platform payment processing.

  • Mercadu.shop shall automatically deduct applicable fees and commissions from the payment before transferring funds to the vendor. Vendors do not need to process or make payments for fees separately.

  • Payments for Mercadu-processed transactions will be held for 5 working days from the date the customer receives the item. This hold ensures that refunds or adjustments can be processed if there are valid issues with the product.

  • By listing products or services on Mercadu.shop, vendors agree to pay all applicable fees and commissions in accordance with Mercadu.shop’s policies.

  • Mercadu.shop reserves the right to update membership plans, fees, or commission rates at any time. Continued use of the platform constitutes acceptance of any updated fees or plans.

  • Vendors who fail to comply with applicable policies may have their listings suspended, removed, or accounts restricted until issues are resolved.

Section 14 – Enforcement & Penalties

Mercadu reserves the right to:

  • Remove or edit listings

  • Suspend or terminate accounts

  • Restrict platform access

  • Take legal or regulatory action when required

Section C – Communication Between Users

15 – Communication Rules and Off-Platform Interactions

Mercadu.shop provides an internal chat system to facilitate communication between customers and vendors.

For convenience and flexibility, customers and vendors may mutually agree to communicate through external messaging platforms, including but not limited to Facebook Messenger, WhatsApp, Viber, SMS, or telephone calls.

All off-platform communications are conducted voluntarily and at the sole risk of the parties involved. Mercadu.shop does not monitor, record, control, or guarantee the accuracy, safety, or reliability of communications made outside the platform.

Any agreements, representations, modifications to orders, or arrangements made outside the official Mercadu.shop system are solely between the customer and the vendor. Buyers and vendors are solely responsible for resolving disputes arising from off-platform communications.

All payments must still be made exclusively through the official Mercadu.shop checkout system. Off-platform payments remain strictly prohibited and are undertaken at the user’s sole risk.

Section D – Platform Use & Content Responsibility

16 – Disclaimers

Mercadu.shop is provided “as is” and “as available,” without any representations or warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

For the Mercadu.shop Affiliate Program, Mercadu.shop does not promote “get-rich-quick” opportunities. Any income, earnings, or business examples provided are for illustrative purposes only. Results will vary depending on individual effort, resources, and circumstances. Past performance or testimonials do not guarantee future success. While Mercadu.shop provides tools and support, outcomes ultimately depend on factors beyond our control. Mercadu.shop and its partners expressly disclaim any and all liability for actions taken based on information, advice, or guidance obtained through the affiliate program or this site.

17 – Limitation of Liability

To the maximum extent permitted by law, Mercadu.shop shall not be liable for:

  • Disputes between buyers and sellers

  • Delivery failures or losses

  • Third-party or affiliate product issues

  • Off-platform communications or payments

  • Indirect, consequential, or incidental damages

18 – Indemnification

You agree to indemnify and hold Mercadu.shop harmless from any claims arising from:

  • Your use of the platform

  • Your listings, transactions, or conduct

  • Violations of these Terms or applicable laws

19 – Changes to Terms

Mercadu may update these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.

20 – Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
